The Inspector-General of Police, Usman Alkali Baba has said, Muhyi Magaji Rimin Gado, a Ex-Anti Corruption Boss in Kano is not above the law or beyond police investigation when concerns allegations of crime.

Baba says the Police is protected under the constitution to investigate and prosecute Rimin-Gado who was suspended from his position as the Chairman of the Kano State Public Complaints and Anti-Corruption Commission.

The IGP made the submissions before Justice Jane Inyang of the Federal high court sitting in Kano.

IGP Baba who affirmed an ongoing Police investigation of Rimin-Gado over alleged forgery of medical certificates submitted to the Kano State House of Assembly insisted that such a process has not violated the fundamental rights of the ex-chairman of the state’s anti-graft agency.

Meanwhile, the Speaker, KanoState Assembly, Hamisu Ibrahim Chedari and the state Attorney General and Commissioner for Justice, Musa Abdullahi Lawan have asked the trial judge, Justice Inyang to refuse the application filed by Rimin-Gado.

Rimin-Gado, who was suspended as Chairman of the Commission had filed an application on the 12th of October 2021, demanding a restraining order against the IGP and the Commissioner of Police in Kano from investigating, arresting or intimidating him.

The Ex-Chairman of Anti-Graft, through his Counsel, S.A Danazumi had joined the Speaker of the State Assembly, Attorney General and Commissioner for Justice as well as the Accountant General of Kano State, as first, second, third and fourth respondents respectively in the suit seeking a restraining order.

The motion brought before the court pursuant to order 2 rule 3 of the fundamental right and section 36, 37, 42 and 46 of the Constitution of the Federal Republic of Nigeria as amended.

Justice Inyang at the last adjournment ordered the six respondents to appear before the court to show course why the applicant’s motion should not be granted.

At the resumption of hearing on the application on Tuesday, counsel to the Inspector General of Police and Commission of Police, Kano, Superintendent of Police S.O Ekwue argued that the applicant has not established any evidence to prove an infringement on his right.

Ekwue who is the Police in charge of legal affairs in Kano Command affirmed the legal authority bequeathed the Police under the law to investigate suspects and prosecute where necessary.

Although counsel to Rimin-Gado argued that Police action contravened the order of the Kano State High Court on the same subject matter, the Police insisted that while the earlier matter dwelt on misconduct and misappropriation, the matter before the Federal high court concerns the forgery of a medical certificate.

Ekwue urged the court to dismiss the application to enable the Police to continue and conclude her investigation against Rim in-Gado.

On his part, counsel to first, second, third and fourth respondents, Barrister W.A Wada equally aligned his argument with the Police calling the court to refuse the application.

However, Justice Inyang stood the matter down for judgment and scheduled it for 28th January 2022.
